I’m only kidding here, so don’t get all smirky at me, but waaaaaay back when Harriet Miers was revealed as Bush’s new SCOTUS pick, I said the whole thing was a rope-a-dope or a head fake.
In fact, what I said was:
My own prediction: She may not make it to the Supreme Court. Bush may not even intend for her to get there. She may be, rather than the “misdirection,” many expected, an out-and-out decoy, floated to allow both the liberals and the conservatives to blast her out of the water so that Bush can then put up another candidate that both left and right - after having behaved very badly over Miers - will not dare to behave badly over, again.
Now, I see this poll over at The Political Teen which suggests (unscientifically and very early into it) that should the Miers nomination be withdrawn, most would prefer to see (my own choice) Janice Rogers Brown get nominated.
Head fake? Was I prescient? I mean…come on, I wrote that within HOURS of the Miers nomination, before the “behaving badly” had even begun in earnest!
If I WAS right, I want something for it. I want candy. Heaven knows my hips and thighs don’t need it. But if I’m right, gimmee candy!

I’m at the point that I’m beginning to feel she is in way over her head and I hope she does either withraw voluntarily or be withdrawn by the president and if that doesn’t happen not get confirmed by the senate.

I seriously doubt that the President would use a friend as a sacrificial lamb. It is just not in his character to act in a Machavelian way towards his close friends. Despite how much political savvy we might describe to Karl Rove - I don’t think the President would bite on this one.
According to CNN, after a meeting with Miss Harriet, Senator Specter told reporters that Miers said she believed the 1965 case of Griswold v. Connecticut was “rightly decided.” The White House is denying this, but if it is true it shows what a disaster this nomination could mean if it goes through. That case had nothing to do with the Constitution and everything to do with overriding and unenforcable law instead of leaving it up to the states to decide.

I think your ‘rope a dope’ analogy is correct- but I differ in conclusion.
I think Harriet Miers will be nominated and confirmed- because with the passage of time, she’s looking better and better. All her early critics have quieted down. There has been no critical mass reached to force the WH to dump her.

I’ve seen no reason to suppose that Miers is in over her head. I’ve heard a lot of pundits speaking out of both sides of their mouths, on the one hand saying that we just don’t know enough about her to be sure she’ll be a good judge, and on the other hand assuring us that Miers is in fact a liberal and will prove to be a disaster as a judge.
All I’ve seen is a lot of people who don’t want Miers on the Court, possibly for reasons that really have little to do with how well or badly Miers would function on the Court.

If Miers goes down after having been savaged by both sides, given that we now know that at least a couple other potential picks already told the White House that they did not want to be chosen, it is very possible, if not likely, that the overwhelming remainder of possibilities will not only say “no,” they will say, “Hell no, I’m not putting myself through that process!” So, it might be nice to have JRB, whom we still would not be 100 percent certain is right on Roe, but after witnessing the lynching of Miers, she may say that wants nothing to do with it all.
